A. Session Fees Client agrees to pay filmmaker a retainer at the time of official booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session. The balance is due before or at the time of the session. The session fee covers the time and talent of filmmaker, basic retouching, and if paid for - the creative editing of film, as determined by the filmmaker. Film(s) to be stored through Dropbox. Additional editing is available at additional expense to be determined by filmmaker. Additional versions of film may be available for purchase. B. Location Costs & Fees If there are any costs/fees associated with the location the client has chosen for their session, you, the client, will be responsible for those fees. The filmmaker will not guarantee or arrange payment on any location. Session fee covers travel within 30 minutes of San Bruno, CA. Any location outside of these limits will be subject to an additional charge to be determined by filmmaker as part of the agreement. C. Rescheduling If an illness or situation prevents a film shoot from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Filmmaker reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. D. Re-shoots / Refunds Re-shoots are determined at the discretion of the filmmaker. Re-shoots and refunds will not be given for regrets of clothing, make-up, hair or weather related issues, or by not following the recommendations of the filmmaker. E. Archive After twelve (12) months, the film will be purged from filmmaker’s hard-drive, except as needed for promotional purposes, to be determined by filmmaker at filmmaker’s sole discretion. Filmmaker is not responsible for loss or damage to the digital files due to circumstances beyond their control. F. Payment All payments are due in full at the time of session unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received. In the event the client fails to remit payment as specified, the filmmaker shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not proceed with the session.  H. Release The client hereby assigns the filmmaker the irrevocable and unrestricted right to use and publish film(s) of the client or in which the client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The client releases all claim to profits that may arise from use of film(s). I. Post Production and Editing The final post production and editing styles, effects, and overall look of the images are left to the discretion of the filmmaker, unless spoken about prior to booking. J. Liability Filmmaker is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their party and for themselves and release filmmaker from any claims against their person or their business.  K. Harassment Policy Filmmaker reserves the right to terminate session if client(s) act inappropriately towards the filmmaker. L. Anti-Discrimination Work Policy The filmmaker does not tolerate hate content – content that expressly and principally promotes, advocates, or incites hatred or violence against a group or individual based on characteristics, including, race, religion, gender identity, sex, ethnicity, nationality, sexual orientation, veteran status, or disability. Filmmaker reserves the right to refuse or cease work that discriminates against any group or individual. The client agrees that they will not use work for hate or discrimination. BY TYPING MY NAME BELOW, IN LEIU OF A SIGNATURE, I AGREE AND ACCEPT THE TERMS LAID OUT IN THIS CONTRACT.
